I'm sure others will have more information on this than I, but suffice it to say that there are Constitutional and legal drivers that provide special status for federally-recognized tribes that require the federal government to establish government-to-government relations with those tribes. I know the Department of Defense has established policy on this and I'm certain other federal agencies, including EPA, have policies, as well.
