I agree that there are times when EPA action is constrained by legal mandates. In these cases, this situation MUST be CLEARLY and REPEATEDLY communicated to the public.

However, in many more cases the Agency's action is not constrained by law but is constrained by politics, most commonly by the political power of polluters, including the federal government. EPA has broad emergency powers under several environmental statutes to stop imminent endangerments to human health or the environment, but only very rarely exercises these powers.

We need to make a very clear distinction between when the Agency is constrained by law and when it is constraining itself by politics.
